Terms & Conditions
Definitions of Terminology Used in This Document:
- A Project refers to any work or service provided by Blue Rock Digital for the client as described in the confirmation order email.
- You or Client refers to the person, business, or organisation using any of Blue Rock Digital’s services.
- We or Us refers to Blue Rock Digital.
- Live Mode refers to the date when the website is made available on the client’s chosen domain.
- Domain is the website address as specified by the client.
- Open Source Software refers to software freely available under the GNU General Public License (GPL).
- Hosting is the annual fee for keeping a client’s website active online.
- Content includes both text and images that the client provides for their website.
- mb stands for megabytes and refers to the measure of storage space.
General
- The contract between Blue Rock Digital and the client is governed by these conditions, which exclude all other terms and conditions. Variations to these conditions will have no effect unless agreed upon in writing.
- The scope of work is outlined in the Blue Rock Digital invoice attached to the confirmation order email.
Legalities, Copyright, and Intellectual Property
- Blue Rock Digital expects the client to carry out proper research to ensure their website or business operates legally. The client is responsible for ensuring that any content, including images, used on the website is legally available. Blue Rock Digital cannot be held responsible for the illegal use of content provided by the client. We reserve the right to remove any website from our servers if it is deemed to be operating illegally.
- Any images purchased by Blue Rock Digital on behalf of the client are restricted by license for use only on the website. Blue Rock Digital is not liable for the misuse of these images by the client or others.
- Blue Rock Digital makes no claim that the content of this website may be legally viewed or downloaded outside of the UK. If accessed from outside the UK, it is done at the user’s own risk. The terms and conditions are governed by the laws of England and Wales, and jurisdiction for claims shall lie exclusively with English courts. Invalidity of any provision does not affect the remaining provisions.
- Blue Rock Digital is not responsible for any adverse impact on the client’s business, sales, or profitability due to services offered by Blue Rock Digital.
Paying for Your Project
- We charge for web design and development in stages. A deposit is required before work begins, and the remaining balance is due before the website is made live. The site will only go live once full payment has been received. The deposit is non-refundable after Blue Rock Digital commits resources or completes research/design work.
- Blue Rock Digital charges a 1.9% fee for payments made by credit/debit card due to fees incurred by our service provider. BACS and cheques are accepted without additional fees. If paying by cheque, work will not proceed until the cheque clears.
- Blue Rock Digital reserves the right to suspend hosting, email hosting, or other services if the account is overdue until payment is received.
- All design and code ownership remains with Blue Rock Digital until full payment is made.
Communication
- Email is the primary method of contact for communication regarding website design and development. For any issues not resolved by email, you can contact our telephone support during UK office hours on 0800 433 7815.
- Clients are responsible for keeping their email address up to date. We are not liable for communication issues if the client fails to provide a valid email address.
- If the client does not respond to Blue Rock Digital within 2 weeks, we will make up to 5 attempts to contact them by email. If no response is received, the project may be terminated, and the deposit will not be refunded. Projects may be archived if postponed without prior notice, with a £50 administration fee for reactivation.
Website Design and Development
- Design is subjective, so we offer design revisions until the client is satisfied with the proposed design. The revision period ends when the client accepts the design. Any changes after approval will incur additional charges.
- Blue Rock Digital will provide an estimated completion time frame for the project if requested.
- Open Source Software (OSS) may be used to speed up development and add functionality. The ownership of the site’s code and customisations will be transferred to the client after final payment.
Hosting and Search Engine Optimisation
- Blue Rock Digital will host the website if requested and after full payment of hosting fees. Standard hosting offers 1GB of storage unless otherwise agreed.
- Hosting renewals are annual. Blue Rock Digital will contact the client one week before renewal. Hosting services will be suspended if renewal fees are not paid on time, with a £50 fee for reactivation.
- If the client does not use Blue Rock Digital hosting, they are responsible for managing and hosting their domain.
- If the client chooses not to renew hosting, the website and associated data can be provided as a backup, subject to a charge.
- Blue Rock Digital is not responsible for changes in search engine ranking caused by website updates or hosting changes.
Domain Names and Links
- Blue Rock Digital will register the domain name for the client once payment is received. The client is the legal owner and can request changes or transfer the domain.
- Blue Rock Digital may provide links to client websites for convenience but cannot guarantee they will remain current or accurate.
- Blue Rock Digital will place a small text link in the website footer acknowledging the design work. This link can be removed upon request.
(*) Harassment Policy
Blue Rock Digital does not tolerate any form of harassment towards its employees. If inappropriate behaviour occurs, Blue Rock Digital reserves the right to cancel the contract without a refund, and any further communication must be made via postal mail only.
